This regulation will be mandatory in all EU member states from August 1, 2030, with some provisions taking effect from January 1, 2026. The new regulation will fully replace the current Directive 2009/48/EC. Key changes include: • The legal form is upgraded from a “Directive” to a “Regulation”, which is directly applicable in all member states without national transposition, ensuring unified and efficient standards. • Mandatory introduction of the “Digital Product Passport”, requiring each toy to have a unique digital identity and compliance information for traceability and supervision. • Significant upgrade in chemical substance management, with comprehensive bans or restrictions on PFAS, multiple types of bisphenols, endocrine disruptors, respiratory sensitizers, etc. Some heavy metal limits are further tightened. • More detailed requirements for warnings and labeling; both online and offline sales must ensure that warnings are clearly visible, supporting digital labeling. • Clear compliance responsibilities for new economic operators such as e-commerce platforms and fulfillment service providers, strengthening traceability and management throughout the supply chain. • Market surveillance and product recall mechanisms are further digitalized and made more transparent. Impact on enterprises: • Companies need to plan ahead and establish digital product passport systems to ensure product information is compliant and traceable. • Product design and raw material procurement must strictly comply with new chemical limits and prohibition lists; some materials may require alternatives. • Supply chain management, compliance documentation retention, complaint and recall mechanisms must be fully upgraded to meet regulatory requirements. • E-commerce and online sales must ensure all compliance information and warnings are clearly displayed on platforms. • It is recommended that companies promptly conduct regulation training, compliance self-checks, and system upgrades to smoothly transition to the new regulation.
