CPSC Issued the Direct Final Rules about the Prohibition of Children’s Toys and Child Care Articles Containing Specified Phthalates
Since 2017, CPSC has issued a series of rules and amendments to regulate the use of specific phthalates on children’s toys and child care articles, including:
1.The 16 CFR Part 1308, effective since Sep. 2017, exempts 7 categories of plastics from 6 phthalates of the statutory prohibition;
2.The 16 CFR Part 1307, will be effective from Apr. 25, 2018, prohibits 8 phthalates (DEHP, DBP, BBP, DINP, DIBP, DPENP, DHEXP, DCHP) from use in children’s toy and child care articles;
3.The 83 FR 3583, which was published on Jan. 26. 2018 on Federal Register and will go into effect on Apr. 25, 2018, exempts 7 categories of plastics from 8 phthalates (DEHP, DBP, BBP, DINP, DIBP, DPENP, DHEXP, DCHP) of 16 CFR Part 1307.
4.The 83 FR 4578, published on Feb. 1, 2018 on Federal Register, specifies the requirements of the new testing method CPSC-CH-C1001-09.4 (2018) for 16 CFR Part 1307 and the operational approach during the interim period, that is,
4.1 CPSC starts the accreditation of CPSC-CH-C1001-09.4 (2018) accreditation from Feb.1, 2018.
4.2 the CPSC will recognize the results of 16 CFR Part 1307, applying the testing method CPSC-CH-1001-09.3 (2010) from the CPSC-accredited laboratories, during the interim period, from Feb.1 ,2018 to Jan. 31, 2020, and the information listed below must be showed in reports “16 CFR Part 1307”and “CPSC-CH-C1001-09.3”
