EU Published Directive 2013/56/EU amending Battery Directive 2006/66/EC

On 10 December 2013, EU published Directive 2013/56/EU amending Directive 2006/66/EC of the European Parliament and of the Council on batteries and accumulators and waste batteries and accumulators as regards the placing on the market of portable batteries and accumulators containing cadmium intended for use in cordless power tools, and of button cells with low mercury content, and repealing Commission Decision 2009/603/EC. This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with Article 1 of this Directive by 1 July 2015.

The main changes are amended as follows:
1. The prohibition shall not apply to button cells with a mercury content of no more than 2 % by weight until 1 October 2015. After that, all button cells shall not contain more than 0.0005% mercury.

2. The cadmium exemption in respect of cordless power tools shall apply until 31 December 2016. After that, cordless power tools shall not contain more than 0.002% cadmium.

3. As regards button cells for hearing aids, the Commission shall maintain under review the exemption and report to the European Parliament and the Council on the availability of button cells for hearing aids which are in compliance with mercury restrict no later than 1 October 2014. Where justified due to the lack of availability of button cells for hearing aids which are in compliance with mercury restrict, the Commission shall accompany its report by an appropriate proposal with a view to extending the exemption with regard to button cells for hearing aids.

4. Batteries and accumulators which do not meet the requirements of this Directive, but which were lawfully placed on the market prior to the date of application of the respective prohibitions in Article 4 of this Directive, may continue to be marketed until stocks are exhausted.
